EU e-Evidence Legal Representative

Service providers outside the EU that offer their services in the Union must name a legal representative to receive European Production and Preservation Orders. We take that role from Germany.

Scope

Who needs one?

Providers established outside the EU that offer these services in the Union:

  • Electronic communications services, including messaging and email
  • Internet domain name and IP numbering services
  • Other information society services that let users communicate or that store data, such as cloud storage, social networks, marketplaces and hosting
  • Offering those services in the Union without a designated establishment in a participating member state

Providers already active in the Union on 18 February 2026 had to designate by 18 August 2026. A provider that starts later has six months.

The role

What the representative is for

Under Art. 3 Directive (EU) 2023/1544, the representative:

  1. 01

Receives European Production Orders and European Preservation Orders under Regulation (EU) 2023/1543 on the provider’s behalf

  2. 02

Is the addressee for the decisions and orders national authorities issue to gather evidence in criminal proceedings

  3. 03

Is notified, with contact details and accepted languages, to the competent authority of the member state where it sits

FAQ

Common questions

No. They are separate roles under separate laws. The e-Evidence representative receives orders from criminal justice authorities; the GDPR representative is the contact for data protection authorities and data subjects. One company can hold both mandates for you.
No. The order is addressed to the representative, but producing or preserving the data stays with you. We receive the order, log it and pass it on so you can respond within the time limit.
Member states set the penalties for not designating a legal representative in their national laws, which must be effective, proportionate and dissuasive.
