EU Digital Services Act Legal Representative

Intermediary services without an EU establishment that offer their service in the Union must designate a legal representative in a member state under Article 13 DSA. We take that role from Germany.

Scope

Who needs one?

Providers established outside the EU that offer these services in the Union:

  • Hosting services, including cloud and web hosting
  • Online platforms such as marketplaces, app stores, social networks and content sharing sites
  • Caching and mere conduit services, such as CDNs, DNS and VPN providers
  • Online search engines

A service counts as offered in the Union when it has a substantial connection to it: a significant number of EU users, or activities targeted at member states.

The role

What the representative is for

Under Art. 13 Digital Services Act, Regulation (EU) 2022/2065, the representative:

  1. 01

Is addressed, in addition to or instead of the provider, by member state authorities, the Commission and the Board on everything needed to receive, comply with and enforce their decisions

  2. 02

Is notified with name, postal address, email and telephone number to the Digital Services Coordinator of its member state, and published by the provider

  3. 03

Can be held liable for the provider’s non-compliance with the DSA, without prejudice to the provider’s own liability

FAQ

Common questions

No. Articles 11 and 12 DSA require points of contact for authorities and for users, which you can run yourself. Article 13 additionally requires a legal representative in the EU if you have no establishment there.
Under Article 13(3) the legal representative can be held liable for non-compliance and must have the powers and resources to cooperate with authorities. That is why the mandate is held by Cloudkasten GmbH, a registered company, and agreed after we have looked at your service.
