IS THIS FOR YOUR BUSINESS?
EU GDPR can apply to a US business without an EU establishment when it offers goods or services to people in the EU, or monitors their behaviour there. You do not need a European office for those rules to apply.
A US SaaS product targeting EU users or a Shopify store marketing to EU shoppers should check its scope. Using a US platform or hosting data in the US does not settle the question.
Businesses that typically check their scope
Exceptions apply. Our representative is established in Germany, so your processing must meet the location requirement in Article 27(3). Read the eligibility FAQs.

Once your designation letter is issued, add the supplied details to your privacy notice.
A company established only in the United States falls under the EU GDPR through Article 3(2) when its processing relates to one of two activities:
What counts is where the individuals are when the goods or services are offered to them or their behaviour is monitored, not their citizenship. A US company in scope must designate, in writing, a representative established in the EU under Article 27(1), and, where it is the controller, name it in its privacy notice under Articles 13(1)(a) and 14(1)(a).
A US group with an EU subsidiary should check which entity runs the processing. Processing in the context of an EU establishment falls under Article 3(1). Processing that the US entity carries out itself and that targets or monitors people in the EU can still fall under Article 3(2) and require a representative for the US entity.
For a private company, the exemption in Article 27(2)(a) covers only processing that is occasional, does not include large-scale processing of special-category or criminal-offence data, and is unlikely to result in a risk to people’s rights and freedoms. Article 27(2)(b) separately exempts public authorities and bodies. A business that serves EU users as a regular part of its model rarely meets it.
Selling only to businesses does not by itself take a company outside the GDPR: the contacts and users at those businesses are individuals whose data the GDPR protects. Neither the GDPR nor the EDPB expressly settles whether a B2B offer counts as offering services to people in the EU under Article 3(2)(a), so the cautious approach is to treat it as in scope; monitoring of EU users under Article 3(2)(b) applies regardless. Where you are the controller, the representative’s name and contact details must appear in your privacy notice under Articles 13(1)(a) and 14(1)(a), so EU customers can see them.
US privacy rules and the EU GDPR apply in parallel; meeting one set does not satisfy the other.
BEFORE YOU START
Yes, when they offer goods or services to people in the EU or monitor their behaviour there and have no establishment in the Union. Article 3(2) then applies the EU GDPR, and Article 27 requires a written designation of a representative based in the EU, unless the narrow Article 27(2) exemption applies.
No. The Data Privacy Framework is a transfer mechanism that lets EU organisations send personal data to certified US companies. The representative duty depends on whether your company targets or monitors people in the EU, and certification does not change that.
No. The CCPA gives rights only to California residents. People in the EU are protected by the GDPR, which has its own requirements, including the Article 27 representative for companies outside the Union that fall under Article 3(2).
In one of the member states where the individuals you serve or monitor are located, under Article 27(3). One representative acts as the contact for supervisory authorities and individuals across the Union; you do not need one per country.
The role is specific to EU GDPR Article 27: a contact in the EU for data subjects and supervisory authorities. It does not replace a US registered agent, create an EU office, or cover your other privacy and international data-transfer obligations.
No. Article 27 generally requires a representative where Article 3(2) applies to a business without an EU establishment. There is an exception for occasional processing that is unlikely to pose a risk to people and does not involve large-scale sensitive or criminal-offence data. Public authorities and bodies are also exempt. Assess your actual activities; business size alone is not an exemption.
Yes, you do not appoint one in every country. Article 27(3) requires the representative to be in a member state where the people whose data you process in connection with offering goods or services, or monitoring behaviour, are located. Cloudkasten GmbH is in Germany: confirm that your activities include people in Germany or otherwise satisfy that requirement before ordering.
After successful company verification and issue of your designation letter. Pay, complete onboarding, and receive your letter before publishing the representative details. Verification may require supporting documents; payment alone does not complete the appointment.
The appointment addresses the representative role. You remain responsible for your processing, records and responses to requests. The subscription does not include a GDPR audit, DPO services or drafting your full privacy policy or Article 30 record.
