EU Data Act Legal Representative

If you make connected products available or offer related or data processing services in the EU without being established there, the Data Act requires a legal representative in a member state. We take that role from Germany.

Scope

Who needs one?

Providers established outside the EU that offer these services in the Union:

  • Manufacturers of connected products placed on the EU market, such as smart devices, vehicles and industrial machinery
  • Providers of related services, for example the app that controls the device
  • Data holders that must make product data available to users and third parties
  • Providers of data processing services, including cloud and edge services subject to the switching rules

Until a representative is designated, the authorities of every member state may act against the provider.

The role

What the representative is for

Under Art. 37(11) Data Act, Regulation (EU) 2023/2854, the representative:

  1. 01

Is designated in writing in one member state and can be addressed by competent authorities on all matters under the Data Act

  2. 02

Brings the provider under the jurisdiction of the member state where the representative is established

  3. 03

Cooperates with the authorities and provides the information they request, without taking over the provider’s own liability
