EU AI Act

Authorised Representative under the EU AI Act

Providers outside the EU must appoint an authorised representative established in the Union, by written mandate, before placing a general-purpose AI model or a high-risk AI system on the EU market. We take that role from Germany.

Scope

Who needs one?

Providers established outside the EU that offer these services in the Union:

  • Providers of general-purpose AI models placed on the EU market (Art. 54)
  • Providers of high-risk AI systems placed on the market or put into service in the EU (Art. 22)
  • Established outside the Union

Article 54 does not apply to GPAI models released under a free and open-source licence, unless the model presents systemic risk.

The role

What the representative is for

Under Art. 54 and Art. 22 AI Act, Regulation (EU) 2024/1689, the representative:

  1. 01

Holds a written mandate and a copy of the technical documentation for the AI Office and national authorities

  2. 02

Verifies that the provider has drawn up the technical documentation and met its obligations

  3. 03

Cooperates with the AI Office and authorities, and terminates the mandate if the provider acts contrary to its obligations

What you receive

What we do as your representative

Written mandate

A mandate that sets out the tasks Article 54(3) or Article 22(3) requires, which we can show to the AI Office on request.

Documentation check

We check that the technical documentation and the information for downstream providers exist before we accept the mandate, and keep a copy for ten years.

Receipt and forwarding

Correspondence from authorities is received at our registered office, logged and forwarded to your named contacts without delay.

A real German company

FAQ

Common questions

The AI Act requires the authorised representative to verify that the provider has drawn up the technical documentation and fulfilled its obligations, and to end the mandate if it has reason to believe the provider is acting contrary to them. So the mandate starts after a review.
The authorised representative duty is on providers. Deployers and importers have their own obligations, which we can look at with you.
